CA: Uber Summary Judgment Motion Denied in Sexual Assault JCCP

Judge Schulman denied Uber’s motion for summary judgment, finding that Uber was a common carrier and thus had a duty to the plaintiffs.  Moreover, the standard was one of a heightened duty of care.  Issues of breach and proximate cause were found to raise disputed issues of material fact.  The ruling is here:  https://aboutblaw.com/bi46  The first bellwether trial is scheduled for next month.  Earlier coverage is here.
